UK Overtime Pay Rules

In the UK, there is no statutory right to overtime pay — it depends entirely on your employment contract. However, your average pay across all hours worked (including overtime) must not fall below the National Living Wage (£11.44 per hour in 2024 for those aged 21 and over).

Many employers pay time-and-a-half (1.5× the regular rate) for overtime, while some pay double time (2×) for work on bank holidays or Sundays. Your contract should specify the overtime rate and any conditions that apply.

If you are on a salary rather than an hourly rate, overtime pay depends on whether your contract includes provisions for it. Some salaried employees receive time off in lieu (TOIL) instead of additional pay.

Is overtime compulsory in the UK?

Your employer can ask you to work overtime, but you can only be required to do so if your contract includes a compulsory overtime clause. You cannot be forced to work more than 48 hours per week on average (unless you opt out).

What is time and a half?

Time and a half means you are paid 1.5 times your regular hourly rate for overtime hours. So if you earn £15/hour normally, you would earn £22.50/hour for overtime.

Does overtime affect my tax?

Yes. Overtime pay is subject to income tax and National Insurance in the same way as your regular pay. If overtime pushes you into a higher tax band, you will pay more tax on the additional earnings.

Can I take time off instead of overtime pay?

Yes — this is called Time Off in Lieu (TOIL). Your employer may offer this as an alternative to overtime pay. The terms should be agreed in writing.
